1. Acceptance of Terms

These Terms & Conditions (together with Privacy Policy) (the “Agreement”) apply to your use of ARK Padel platform and all related products and services (“Service”). In this Agreement, “ARK Padel” and “we” mean the ARK Padel company and “you” and “your” means any party using the Service (a “User”).

By creating an account on ARK Padel and/or using the Service, you acknowledge that you have read, understand, and agree to be bound by this Agreement; and you represent and warrant that you are of legal age and not prohibited by law from accessing or using the Service.

2. Nature of Service

The Service is designed to facilitate Padel matchmaking, session organization, and skill-based rating tracking. The Service may enable:

  • Users to communicate among themselves;
  • Users to view and evaluate sessions and to register for participation;
  • Users to pay subscription fees for premium services;
  • Users to create and manage their Account;
  • ARK Padel to manage memberships and registrations.

ARK Padel is not a court booking service. Users are solely responsible for securing physical court reservations at venues.

3. Physical Activity & Liability Waiver

Assumption of Risk: You acknowledge that participation in padel involves inherent risks, including physical injury, illness, or death. By participating, you voluntarily assume all such risks.

Release and Waiver: To the fullest extent permitted by law, you release ARK Padel and its affiliates from any claims or liabilities arising from injuries or property damage sustained during participation.

Health Warranty: You warrant that you are in good physical condition and have no medical condition that would impair your ability to safely participate.

4. Competitive Integrity & Ratings

Users agree to provide accurate and truthful information regarding match results and scores.

Fair Play:Prohibited conduct includes submitting false results, “sandbagging”, “smurfing”, or colluding to manipulate Ratings.

ARK Rating: The Rating is a proprietary calculation and is final and binding for matchmaking purposes. Manipulation may result in account suspension.

5. User Conduct

  • No-Show Policy: Repeated failure to attend confirmed sessions without notice may result in account restrictions.
  • Safety: Harassment, discrimination, or unsportsmanlike conduct will not be tolerated and may lead to immediate termination.

6. Creating an Account

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. You agree to provide accurate Profile Data and not to create more than one Account.

7. Fees, Payment, and Transactions

By booking a session, you agree to the applicable Session Fees and third-party rules. ARK Padel acts as a facilitator and does not provide reimbursements for sessions or transactions.

8. Term and Termination

ARK Padel may terminate or suspend your Account at any time without notice if we believe you have breached this Agreement. You may also deactivate your Account at any time.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” BASIS. ARK PADEL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARK PADEL SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR PARTICIPATION IN ANY SESSIONS.

11. Governing Law

This Agreement is governed by the laws of the Republic of Indonesia. Disputes shall be subject to the exclusive jurisdiction of the Central Jakarta District Court.

12. General Terms

This Agreement contains the entire agreement between you and ARK Padel regarding the use of the Service. If any provision is held invalid, the remainder shall continue in full force.
