1. Introduction

This Privacy Policy explains how ARK Padel (‘ARK Padel’, ‘we’, ‘us’) collects, uses, discloses and protects your personal data when you use the ARK Padel mobile applications, website, and ARK Padel platform (collectively, ‘ARK Padel’).

We comply with Law No 27 of 2022 on Personal Data Protection (Indonesian Personal Data Protection Law).

This Privacy Policy applies to any personal information used as part of the Service, as it is defined in our Terms & Conditions. Additionally, capitalized terms used in this Policy have the same definitions as in our Terms & Conditions.

2. Data Collection

In compliance with the Indonesian Law No. 27 of 2022 on Personal Data Protection (UU PDP), we collect the following categories of personal data:

  • Identity Data: Name, email address, gender, and date of birth.
  • Location Data: We require access to your GPS location to filter and display nearby Padel Sessions, Venues, and Clubs.
  • Performance Data: Match results, win/loss records, points records, and your ARK Rating.

3. Use of Data

Ultimately, we use your personal information to provide you with the Service. More specifically, the purposes for which we collect, use, and disclose your personal information are to:

  • Matchmaking: Your Rating and location are used to pair you with appropriate sessions and opponents.
  • Public Profile: Your Name, Initials, Rating, and Match History are visible to other users of ARK Padel to maintain a transparent competitive environment.
  • Communications: Your email is used for OTP verification and critical session notifications.

4. Consent

When you use the Service, your consent will be implied in certain circumstances, most often when you willingly and intentionally provide us with your personal information, including directly in writing or electronically.

We also rely on third parties for your consent when you access our offering using other services that you have disclosed your personal information to, and those services are permitted to disclose it to us.

We may also seek your express consent to the collection, use or disclosure of your personal information. Most often, we will seek your express consent when it is highly sensitive or required for a new purpose. We may obtain your consent by your checking of a box, your acquiescence to an agreement or by you taking another affirmative action.

5. Data Sharing & Third Parties

We will not transfer your Personal Information to third parties without your express consent, except for as detailed in this Section. These third parties include our trusted service providers and advertisers. We share data only with essential service providers:

  • Authentication: For secure OTP delivery.
  • Analytics: We use PostHog to track app performance and user behavior to improve the ARK Padel experience.
  • Cloud Storage: Your data is encrypted and stored in secure cloud environments (Supabase/AWS).
  • Platform Providers: We may share certain information with platform providers such as Apple and Google, including through their respective operating systems, app distribution platforms, and embedded services.
  • Payment Processing: We disclose your Personal Information to payment processors engaged to facilitate transactions.

We also share anonymized statistics pertaining to Users’ general behaviour.

We may also disclose or transfer your personal information to the extent required to by law or in the good faith belief that such action is necessary to: (i) comply with applicable laws or with legal process served on us; (ii) protect or defend our rights or property; (iii) act in urgent circumstances to protect the personal safety, property, or privacy of our employees, users, or members of the public; or (iv) effect a transaction, restructuring or proceeding that transfers to a third party the assets or line of business to which the information pertains.

6. Data Retention & Deletion

You have the right to request the deletion of your account and personal data at any time via the app settings. Upon deletion, your personal identity will be scrubbed, though historical match results may be retained in an anonymized format to maintain the integrity of other players’ Ratings.

7. Data Security

Your personal information is protected for your privacy and security. We safeguard the security and confidentiality of your data using physical, technical, and operational procedures. Please be aware that, despite our best efforts, no security measures are perfect or impenetrable.

8. International Transfer

Your information may be transferred to, and maintained on, computers located outside of your jurisdiction, where the privacy laws may differ from, and may not be as protective as those in your jurisdiction.

9. Changes to this Policy

If we decide to make material changes to our Privacy Policy, we will notify you and other users by placing a notice on our website.

Where appropriate, we may also provide notice of such changes through additional communication channels, including:

  • via in-app notifications or updates distributed through the Apple App Store and/or Google Play Store; and/or
  • by sending a notification to the email address associated with your account.

We will use commercially reasonable efforts to ensure that such notifications are provided through the most effective means available to us at the relevant time.
